These Terms of Use govern your access to and use of the KALM application and website (collectively, the "Service"), operated by Keren Levy-Bildi, trading as KALM, an Einzelfirma based in Kilchberg, Canton of Zurich, Switzerland.

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

KALM is a personal wellness application designed to support subconscious reprogramming through personalized affirmations, ambient sound, and the Schumann resonance frequency. KALM is not a medical device and makes no medical claims. See the Disclaimer section below for full details.

2. Eligibility

You must be at least 18 years of age to use KALM. By using the Service, you represent and warrant that you meet this requirement.

3. Payments

KALM is offered as a one-time purchase with no recurring subscription. Payment is processed securely through Stripe. All prices are listed in USD.

Once a purchase is completed and access has been granted, no refunds will be issued unless expressly required by applicable Swiss consumer protection law.

4. License

Upon purchase, KALM grants you a personal, non-transferable, non-exclusive license to use the application on your own devices for personal use only. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service.

5. AI-Generated Content

KALM uses artificial intelligence to generate personalized affirmation scripts based on the desires you provide. These scripts are intended for personal use only. KALM does not claim ownership of the content you provide, and you retain full responsibility for the information you enter into the application.

6. Intellectual Property

All content, design, code, branding, and materials associated with KALM are the intellectual property of Keren Levy-Bildi trading as KALM. Unauthorized reproduction or use is prohibited.

7. Limitation of Liability

To the fullest extent permitted by Swiss law, KALM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. The total liability of KALM for any claim shall not exceed the amount you paid for the Service.

8. Changes to Terms

KALM reserves the right to update these Terms at any time. Continued use of the Service after changes have been posted constitutes your acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Canton of Zurich.

Privacy Policy

Your privacy matters. This Privacy Policy explains what information KALM collects, how it is used, and how it is protected. KALM is designed to collect as little data as possible.

1. Data Stored on Your Device

The following information is stored locally on your device only and is never transmitted to our servers: your voice recordings, session settings, streak count, language preference, and disclaimer acceptance status. This data remains under your full control and is deleted when you uninstall the application.

2. Data Sent to Third-Party Services

When you generate an affirmation script, the desires you enter are sent to the Anthropic API for processing. This data is used solely to generate your script and is subject to Anthropic's privacy policy, available at anthropic.com. KALM does not store this data on its own servers.

Payment data is processed entirely by Stripe. KALM does not have access to or store your payment card details. Stripe's privacy policy is available at stripe.com.

3. Data We Do Not Collect

KALM does not collect your name, email address, location data, device identifiers, or any other personal information unless you voluntarily provide it when contacting us for support.

KALM does not use analytics tools, tracking pixels, cookies, or third-party advertising services.

4. Children's Privacy

KALM is not intended for users under the age of 18. We do not knowingly collect any information from minors.

5. Your Rights

Under Swiss data protection law (nDSG) and the European General Data Protection Regulation (GDPR), you have the right to access, correct, or delete any personal data we hold about you. Since KALM stores data locally on your device, you can delete this data at any time by clearing the app data or uninstalling the application.

Use While Driving

Never use KALM while driving, operating machinery, or in any situation requiring your full attention. KALM is designed exclusively for use in a safe, stationary environment before sleep or after waking.

The affirmation scripts, Schumann frequency, and ambient sounds provided by KALM are intended as complementary wellness tools. Individual results may vary. KALM makes no guarantee of specific outcomes.
